-LONG TEXT POST - EVIDENCE ATTACHED-
NOTE: This post has no intention to aggressively or negatively affect any users. It’s a warning for the artists to take the necessary measures when dealing with the following user:
@swthedragonarist16 on Tumblr @SkeleSabiArtist on Twitter During these years, Underverse and XTale, fan-series created by me, Jael Peñaloza (a.k.a Jakei) have drawn a lot of attention in the Undertale Alternate Universe community. The motives are diverse, and I receive great amounts of support and admiration from people, who motivate me to continue with this work until the end. It hasn’t been an easy job since I’m the only one working on the animations and comics, as well as a small amount of merchandise through conventions and support from small indie businesses also formed by fans. A topic that always generates debate in this type of fandoms is the denominated “ship” or romantic pairings between original characters (OCs). sonas or fan-characters (FCs) . Some people consider it something very scandalous and silly. Others simply ignore it and let it continue, since it’s apparently not causing any kind of harm to people in real life, and artists and fanfic writers who elaborate this type of works improve their artistic abilities and can meet new friendships through the internet. Personally, I’ve never cared about people using my characters to create their own stories and playing them, their own way. I eventually learned that my fan-characters are precise of the FCs type, I’m an Undertale fan. My XTale characters aren’t original, Underverse is a crossover of other artists’ fan-characters, derived from an already existing work. Pretending they’re of my total authorship and demanding each artist or writer to follow my story’s canon or designs would be absurd and hypocritical. The magic of fandoms is to open new possibilities to explore a character or original plots more in-depth.
I was part of the creation of the Cross X Dream ship, and even though I no longer make content of it, and I’ve cut communication with Dream’s creator, this experience helped me mature even more, and use this story for my future original projects, where besides the amount of trouble this caused to both of us, I can now develop better characters inspired by what we’ve done. I kept the right to not give my opinion about it and to let people continue making works about an alternate story that they really liked, even making a better work than mine. Despite the persistent comments or forceful demands to make said story official, I withhold my right to stay silent. After all, everyone’s free to do whatever they want with fictional characters… …As long as they don’t hurt real people.
Sabi is a user who really admires XTale, especially the fan-character Cross!Sans. Like any other fan, she really appreciates him, either because of his backstory or his design. However, over time, her affection ended up turning into a self-centered, pretty harmful obsession, where several artists external to the creation of this AU were involved, where she disapproves of content that has nothing to do with her self-insert and “Cross x Sabi”, her ship which basically she considers “official”.

Comment from an artist from another callout post on Tumblr warning people about Sabi’s behavior months ago.
Her extreme obsession with my character ended up in constant demands of fan-arts, art-trades, and even commissions about her relationship with a fictional character. To the point of getting to scam some artists or making wait clients for long time with vague responses, or accusing them that they are bulling her, threaten them with the words “You’ll have my blood on your hands”.

When an artist rejects her requests, her behavior turns from friendly to pretty passive-aggressive. A more experienced artist could simply ignore her, but unfortunately, many artists in this community suffer from anxiety or depression. With a simple comment of this kind, they can be given a hard time, and consequently, they acquire hatred towards my creation due to her behavior.
She assures she suffers from psychological issues which prevent her from properly dealing with people, but she always uses it as an excuse when being confronted, either when asking about commissions or art-trades that she never delivers, or when her attitude is questioned.
During this last year, many testimonies from people related to Sabi have come to me, and this isn’t just some complot to ruin someone’s reputation. This situation is very serious and it’s getting out of hand, all because I didn’t take the appropriate measures about it.
She doesn’t represent my work, nor the rest of my followers and the Undertale fandom.
This evidence can show what’s been going on, and that’s not counting the amount of stress and discomfort this is causing me as the creator of the XTale AU and Cross!Sans. Due to this, I finally decided to make this post to warn other artists about her behavior, and I also want to get her attention so she understands not only the harm she’s causing to other people in real life but also the harm she’s doing to herself over a fictional character.
[-POST EN ESPAÑOL]
(Children’s Online Privacy Protection) was announced and is going to make drastic changes on Youtube’s platform next year.
Originally, it was planned that these guidelines would be applied on YouTube Kids to prevent children from sharing their information, however, it has ended up being imposed on the entire platform. YouTube users received a notification through an email where they should be responsible for the audience to which their videos are aimed for. Currently these guidelines the FTC has released so far are pretty vague, and there’s a lot of concern in a huge part of YouTube community, not only in the United States but globally, since the users would be getting a fine of approximately $40000 dollars for incorrectly setting the video to the wrong audience (by them or the Youtube automated systems), even if we are not living in the United States. Users that have created content aimed for children -anybody under 13- will lose some functions in their videos/channels: -Notifications will be deactivated. -Comments will be deactivated. -Videos will no longer appear in the search engines. -Videos won’t be recommended -Ads will be reduced by 90% -Live functions like Super Chat will be deactivated.
Channels that set their content as NOT aimed for children under 13, will also be affected in terms of decreasing their income, and basically being censored since it’s supposed to be “mature” content.
Channels which content is aimed for teenagers or young adults -from 13 to 28 and more- will be affected unfairly, since this law considers “only for kids” videos that contain animations, cartoonish characters, colorful pictures/sequences or toys, as well as videos using slang words or pop culture terms like “fun” “free gifts” “duh” “whatever”, etc.
As for animation channels using the words “animation” or “animated” in the titles, descriptions or tags will also be flagged as content made for kids even if the topics of the videos are aimed for teenagers or adults. The animators would be affected by losing the channel functions mentioned before, getting a huge decrease in their revenue and the risk of being fined for making inappropriate content disguised as “flashy videos for kids.”
The FTC is still open to comments until December 9th. If you want to help, here’s the link to send them a comment about this situation. PLEASE DON’T SEND HATE OR TREATS. We must let them know these changes are very aggressive with a huge part of Youtube Content Creators.
There’s also a petition you can sign to save Youtube’s Family Friendly content, and prevent this affect other internet platforms in the future.
Also, this is a video talking about this topic that is being a trend on Youtube. We gotta spread this thing, guys. Many artists, gamers and family friend content creators, new ones and popular ones are all in danger.
You may have heard about the efforts in Europe to reform copyright law. The debate has been ongoing in the European Parliament for months. If approved next week, these new regulations would require us to automatically filter and block content that you upload without meaningful consideration of your right to free expression.
We respect the copyrights and trademarks of others, and we take all reports seriously to ensure that your creative expression is protected. We make this clear in our Community Guidelines. There’s already a legal framework that works and is fair: Today we take down posts and media that contain allegedly infringing content when we receive a valid DMCA (Digital Millennium Copyright Act) takedown request. We also provide clear-cut ways for people to fight back if they believe their removed content was not a true violation. These instances are monitored and reported and live in our biannual transparency report.
The suggestion to use automated filters for issues of copyright is short-sighted at best and harmful at worst. Automated filters are unable to determine whether a use should be considered “fair use” under the law and are unable to determine whether a use is authorized by a license agreement. They are unable to distinguish legitimate parody, satire, or even your own personal pictures that could be matched with similar photographs that have been protected by someone else. We don’t believe that technology should replace human judgment. Tumblr is and always has been a place for creative expression, and these new regulations would only make it harder for you to express yourself with the freedom and clarity you do so now.
If you access Tumblr from Europe and want to act, you can find more information on saveyourinternet.eu.
